Part One: Terms of Use
1. Introduction and Acceptance
Welcome to charlottesymphony.org (the "Site"), operated by the Charlotte Symphony Orchestra Society, Inc. (“Charlotte Symphony Orchestra,” "Charlotte Symphony," "we," "us," or "our"). These Terms of Use (these "Terms") govern your ("you" or "your") access to and use of the Site. By using the Site, you agree to these Terms. If you do not agree, please do not use the Site.
These Terms work together with our Privacy Policy in Part Two below, which explains how we collect, use, and share your information.
2. Changes to These Terms
We may update these Terms from time to time. When we do, we will revise the "Last Updated" date below and, for material changes, provide additional notice on the Site. Your continued use of the Site after changes are posted means you accept the updated Terms.
3. Using the Site
We grant you a limited, non-exclusive, non-transferable, revocable license to access and use the Site for personal, non-commercial purposes, such as browsing concert listings, purchasing tickets, making donations, and learning about our programs. You agree not to:
- Copy, modify, or create derivative works from the Site or its content for commercial purposes;
- Reverse engineer, decompile, or attempt to access the Site's underlying source code;
- Use automated tools, such as bots or scrapers, in a way that places unreasonable load on our systems; or
- Resell tickets purchased through the Site except in accordance with applicable law and our ticketing policies.
We may suspend or terminate your access to the Site if we reasonably believe you have violated these Terms.
4. Accounts
Certain features of the Site — such as purchasing tickets, managing a subscription, or making a donation — may require an account or information submitted through our ticketing or donation platform(s). You are responsible for providing accurate, current information, keeping any login credentials confidential, and all activity under your account. Please notify us promptly if you suspect unauthorized use of your account.
5. Tickets and Performances
By purchasing a ticket or attending a Charlotte Symphony performance, you agree to the following:
- All ticket sales are final. Refunds and exchanges are available only as described in our ticketing policies, or if a performance is canceled and a substitute or rescheduled performance is not made available within a reasonable time.
- Programs, artists, dates, times, venues, and pricing are subject to change without notice. We will make reasonable efforts to notify ticket holders of significant changes.
- Your ticket is a revocable license. We may refuse admission to, or remove, any person who violates venue policies, applicable law, or engages in disorderly conduct, without obligation to refund the applicable ticket.
- Performances may be recorded or photographed for archival, marketing, or broadcast purposes. By attending, you consent to being incidentally included in such recordings and to our reasonable use of them.
- Unauthorized recording, photography, or broadcasting of performances is prohibited unless we state otherwise for a specific event.
- Late seating may be restricted at the discretion of venue staff to avoid disrupting a performance in progress.
6. Discount Programs
From time to time, we offer discount programs (such as Music for All, Kids Go Free Sundays, and Subscriber Savings). Each program has its own eligibility requirements and terms, described on the applicable program page, which take precedence over the general provisions of these Terms in the event of a conflict.
7. Intellectual Property
All content on the Site — including text, graphics, logos, photographs, audio and video recordings, and musical works (the "Content") — is owned by Charlotte Symphony or its licensors and is protected by U.S. and international copyright, trademark, and other intellectual property laws.
You may view and share Content for personal, non-commercial purposes, such as sharing a concert listing on social media. You may not reproduce, distribute, publicly perform, or create derivative works from Content for any commercial purpose without our prior written consent.
If you believe content on the Site infringes your copyright, please send a notice to:
Charlotte Symphony Orchestra, c/o Legal Inquiries, at the address below that includes: (a) identification of the copyrighted work; (b) identification and location of the allegedly infringing material on the Site; (c) your contact information; and (d) a statement of your good-faith belief that the use is unauthorized. We will review and respond to valid notices in accordance with applicable law.
8. User-Submitted Content
If you submit content to the Site — a comment, review, photo, or testimonial, for example — you confirm that you have the right to share it and that doing so does not violate any law or any third party's rights. You grant Charlotte Symphony a non-exclusive, royalty-free, worldwide license to use, reproduce, and display that content in connection with operating and promoting the Site and our programs. We may remove user-submitted content at our discretion.
9. Prohibited Conduct
You agree not to use the Site to:
- Violate any applicable law or regulation;
- Post or transmit unlawful, defamatory, abusive, or obscene material;
- Interfere with or disrupt the Site's functioning, including through viruses or malicious code;
- Attempt to gain unauthorized access to any part of the Site or its systems; or
- Impersonate any person or misrepresent your affiliation with any person or entity.
10. Third-Party Links
The Site may link to third-party websites — such as our ticketing partner, donation processor, class registrar, or social media pages — for your convenience. We do not control, and are not responsible for, the content, privacy practices, or terms of those sites. Visiting a linked site is at your own risk and subject to that site's own terms.
11. Accessibility
Charlotte Symphony is committed to making the Site usable by the widest possible audience and to providing accessible experiences at our venues. We aim to follow generally accepted accessibility standards, such as WCAG 2.1 Level AA. If you have trouble accessing any part of the Site or need an accommodation, please contact us at ticketoffice@charlottesymphony.org and we will work with you to provide the information or service you need.
12. Disclaimers
The Site and its Content are provided "as is" and "as available," without warranties of any kind, whether express or implied, including warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not guarantee that the Site will be uninterrupted, secure, or error-free, or that any defects will be corrected.
13. Limitation of Liability
To the fullest extent permitted by law, Charlotte Symphony and its officers, employees, board members, and volunteers will not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of, or inability to use, the Site, even if advised of the possibility of such damages. Some jurisdictions do not allow certain limitations of liability, so some of the above may not apply to you.
14. Indemnification
You agree to indemnify and hold harmless Charlotte Symphony from claims, damages, and reasonable expenses (including attorneys' fees) arising from your violation of these Terms or your misuse of the Site.
15. Governing Law and Disputes
These Terms are governed by the laws of the State of North Carolina, without regard to conflict-of-law principles. Any dispute relating to these Terms or the Site will be resolved exclusively in the state or federal courts located in Mecklenburg County, North Carolina, and you consent to the jurisdiction of those courts.
16. Severability
If any provision of these Terms is found unenforceable, the remaining provisions will remain in full force and effect, and the unenforceable provision will be modified to the minimum extent necessary to make it enforceable.

Part Two: Privacy Policy
Charlotte Symphony ("we," "us," or "our") respects your privacy and is committed to being transparent about how we collect, use, and share information about you. This Privacy Policy explains our practices for the Site and any other Charlotte Symphony digital platforms that link to this policy.
1. Scope
This Privacy Policy applies to personal information we collect through the Site, our ticketing and donation platforms, our email communications, and other digital channels that link to this policy. It does not apply to information collected offline — for example, at the box office — except where that information is also entered into the systems covered by this policy.
2. Information We Collect
We collect information you provide directly to us, such as when you:
- Purchase tickets or a subscription;
- Make a donation or become a member;
- Register for an education program, camp, or community event, including on behalf of a minor;
- Sign up for our e-newsletter or other communications;
- Apply for a job, audition, or volunteer opportunity;
- Enter a contest, sweepstakes, or promotion;
- Contact Patron Services or otherwise communicate with us; or
- Submit comments, reviews, photos, or other content to the Site.
This information may include your name, mailing and billing address, email address, phone number, payment information, birthdate (where relevant to a program, such as Kids Go Free Sundays or a youth education program), and anything else you choose to provide.
We also collect certain information automatically when you use the Site, including your IP address, device and browser type, the pages you view, and how you arrived at and navigated the Site. This information does not by itself identify you personally, but we may combine it with other information as described below.
3. Cookies and Similar Technologies
We use cookies and similar technologies to operate the Site, understand how it's used, and support our marketing. These generally fall into the following categories:
- Strictly Necessary Cookies — required for core Site functions, such as completing a ticket purchase.
- Analytics/Performance Cookies — help us understand how visitors use the Site so we can improve it.
- Functional Cookies — remember your preferences to improve your experience.
- Advertising Cookies — used by us or our advertising partners to deliver more relevant Charlotte Symphony ads on other websites and to measure their effectiveness.
Most browsers let you control or block cookies through their settings; doing so may limit some Site functionality. We do not currently respond to browser "Do Not Track" signals, as there is no common industry standard for how to interpret them. You can learn more about, and opt out of, Google Analytics tracking through Google's tools.
4. How We Use Your Information
We use the information we collect to:
- Process ticket purchases, subscriptions, donations, and memberships;
- Communicate with you about your orders, account, or requests;
- Send newsletters, season announcements, and promotional communications, with an opt-out always available;
- Administer education and community programs, including those involving minors;
- Improve and secure the Site and our services;
- Comply with legal obligations; and
- Pursue our nonprofit mission, including fundraising and donor stewardship.
5. How We Share Your Information
We do not sell your personal information. We share it only as follows:
- Service Providers — vendors who perform services on our behalf, such as our ticketing platform, payment processors, digital asset management system, email marketing platform, and data hosting providers. These providers may use your information only to provide services to us.
- Other Nonprofit Organizations — from time to time, we may exchange donor or patron names and mailing addresses with other arts and cultural nonprofits to support our shared mission. You may opt out of this sharing at any time; see Section 6 below.
- Legal and Safety Reasons — when required by law, requested by a court order or subpoena, or necessary to protect the rights, property, or safety of Charlotte Symphony, our patrons, or others.
- Business Transfers — if Charlotte Symphony is involved in a merger, reorganization, or transfer of assets, your information may be transferred as part of that transaction, subject to confidentiality protections consistent with this policy.
- With Your Consent — for any other purpose disclosed to you at the time you provide the information.
6. Your Privacy Choices
Marketing communications
You can unsubscribe from emails at any time using the link in any message, or by contacting us using the information in Section 12.
Nonprofit information sharing
You can opt out of having your name and address shared with other nonprofit organizations, as described in Section 5, by contacting us.
Access, correction, and deletion
Depending on where you live, you may have the right to request access to, correction of, or deletion of your personal information, or to ask that we limit certain uses — for example, if you are a resident of California or another state with a comprehensive privacy law. We do not sell personal information or share it for cross-context behavioral advertising in a way that would currently require an opt-out under most state privacy laws; if that changes, we will update this policy and provide the required choice. To exercise these rights, contact us using the information in Section 12. We will not discriminate against you for exercising your privacy rights.
7. Security
We use reasonable administrative, technical, and physical safeguards designed to protect your information, including encryption (such as TLS/SSL) for data submitted through the Site and secure handling of payment information by our payment processors. No method of transmission or storage is completely secure, and we cannot guarantee absolute security.
8. Data Retention
We retain personal information for as long as reasonably necessary to fulfill the purposes described in this policy, comply with legal and accounting requirements, and support our donor and patron relationships, after which we securely delete or anonymize it.
9. Children's Privacy and Education Programs
The Site is not directed to children under 13, and we do not knowingly collect personal information directly from children through the Site. Our education programs, school partnerships, and family events sometimes involve participants under 18; in those cases, a parent, guardian, or school provides information on the minor's behalf, and we collect only what is reasonably necessary to administer the program. If you believe we have collected information directly from a child without appropriate parental or guardian involvement, please contact us so we can address it.
10. Third-Party Links
The Site may link to third-party sites, including our ticketing and donation platforms, social media pages, and partner organizations. This Privacy Policy does not apply to those sites, and we encourage you to review their privacy policies.
11. Changes to This Privacy Policy
We may update this Privacy Policy from time to time. We will post the revised policy with an updated "Effective Date" and, for material changes, provide additional notice as appropriate, such as a banner on the Site.
